The Holiday Place PLC – ATOL 3101 ceased trading on 29th May 2019.

The company based in London traded under the names, The fishing place, The scuba place Cubaholidays.co.uk, Dubaiholidays.co.uk, Cuba Holidays, Holiday place, Ocean Jewels, Holiday USA, Egypt Direct, Dubai Direct, Go Dominican Holidays, Just Caribbean, The Cuba Experience, The Cyprus Experience, The Kenya Experience, The Mexico Experience;  and websites www.theholidayplace.co.uk, www.thescubaplace.co.uk, www.holidayplace.co.uk, www.cubaholidays.co.uk, and www.dubaiholidays.co.uk.

The following information is for ATOL protected bookings.  You can tell if your booking is ATOL protected by the documents issued to you at the time you booked.  ATOL holders are required to issue ATOL Certificates and ATOL confirmations (for Package bookings).

Consumers currently overseas on Package and Flight-Only bookings

Flight arrangements

If you are currently overseas and you hold a schedule flight e-ticket, the flight remains valid for the return journey. You are advised to check-in with the airline as normal.

Accommodation and other tourist service arrangements

The CAA is speaking to the overseas providers to guarantee the services you booked. However, if you are required to pay again for services that were part of your original trip, please ensure that you retain a clear receipt showing the method of payment; as this is required for any claim. If you pay in cash, you must obtain a cash receipt as you cannot make a claim without this.

There is a helpline for consumers currently overseas. The telephone number is 0333 103 6350. Costs cannot be refunded for calling the helpline.

If you only booked Accommodation only with the failed ATOL holder, your booking is not ATOL protected.

Consumers due to travel from 29th May 2019 onward

Package bookings

If you have flight tickets the flight may be valid. Passengers are advised to check with the airline. If the airline confirms you have a valid ticket for travel, you have two options;

Option 1. If you do not wish to use your flight, you can make a claim for a refund for the amount you paid to The Holiday Place PLC for your ATOL protected Package (subject to your original method of payment).  Also applicable for passengers with non-valid flights.

Option 2. You can use your flight and if you are asked to pay again for the other elements included in your original Package, you may claim for the cost of replacing these (subject to your original method of payment).

Other services may not have been paid to the local suppliers and you may be required to re-arrange and pay for these services again.   To avoid any issues in resort, you should confirm the cost of all the elements in advance of travel.

However, there is a limit to the amount you can claim. For details of your claim entitlements, please view the ATT Payment Policy.

Please note that if you choose to travel and use your valid flight, you are not protected under The Package Travel and Linked Travel Arrangements Regulations 2018, as your package travel provider has ceased to trade.  You will therefore be responsible for any risks arising from each individual element of your trip which would have previously been protected

Consumers who choose Option 2 and decide to travel, if you originally paid The Holiday Place PLC by credit card, then your claim for replacement elements will be from your credit card company.  The amount you can claim from your credit card company will be capped at the value of your original credit card transaction.  If your replacement element claim exceeds this sum, you may claim the remainder from ATOL.

The replacement items must either match the original booking or be of the same standard, board basis, room type, tour etc, as the original.  Details of documentation required for making a claim can be found in the claim guidance.

Please note claims cannot exceed the total cost of the original booking made with The Holiday Place PLC.

Flight-Only bookings

If you have a flight ticket, your flight should be valid and you should still be able to travel.

The best way to check is to contact the airline.  If the airline advises you that a ticket has not been issued or is not valid, ask them to confirm this in writing, you will need this confirmation to make a claim.  You can only claim a refund under the ATOL scheme if your flight is ATOL protected and you have not received a ticket.

Who do I claim from?

Depending on your booking type and original method of payment, your claim will either be with the CAA or with your credit card provider.

Package bookings made directly with The Holiday Place PLC

If you paid for your original trip by credit card to The Holiday Place PLC, you should claim from your credit card provider.  If you are choosing to travel, you should check with your credit card provider prior to travelling to establish what your claim entitlement amount is. You will only be entitled to claim for any replacement costs from ATOL up to the cost of your original trip less the amount originally paid by credit card.

If you paid for your original trip using part credit card and other methods to The Holiday Place PLC, you should claim from your credit card provider for the portion you paid by credit card, and the CAA for payments by other methods.  If you are choosing to travel, you should check with your credit card provider prior to travelling to establish what your claim entitlement amount is. You will only be entitled to claim for any replacement costs from ATOL up to the cost of your original trip less the amount originally paid by credit card. If you do not travel you will be entitled to claim for the payments by credit card from your credit card provider and the other methods of payment from ATOL

If you paid for your original trip by any method other than credit card to The Holiday Place PLC, your claim will be with ATOL. If you choose to travel and are requested to pay again to replace elements of your original booking, you will be entitled to claim for the replacement costs from ATOL up to the cost of your original booking.  If you do not travel you will be entitled to claim from ATOL.

Package bookings made with a travel agent of The Holiday Place PLC

If you paid for your original trip by any method to an agent of The Holiday Place PLC, your claim will be with ATOL. If you choose to travel and are requested to pay again to replace elements of your original booking, you will be entitled to claim for any replacement costs from ATOL up to the cost of your original booking.  If you do not travel you will be entitled to claim from ATOL.

Flight-Only bookings made directly with The Holiday Place PLC

You may only make a claim if you do not have a ticket. Tickets issued should be valid for travel.

If you paid by credit card directly to The Holiday Place PLC, you should claim from your credit card provider.

If you paid by credit card and other methods directly to The Holiday Place PLC, your claim will be with the credit card provider for the portion you paid by credit card, and ATOL for payments by other methods.

If you paid by any method other than credit card directly to The Holiday Place PLC, your claim will be with ATOL.

Flight-Only bookings made with an agent of The Holiday Place PLC

You may only make a claim if you do not have a ticket. Tickets issued should be valid for travel.
If you paid by any method to an agent of The Holiday Place PLC, your claim will be with ATOL.

Accommodation only bookings

Bookings which do not include a flight element are not covered by the ATOL scheme and consumers should contact ABTA on www.abta.com.

Travel Agents Information

If you are a travel agent of The Holiday Place PLC and you are currently holding consumer payments which you have not yet paid to The Holiday Place PLC, you are advised not to refund consumers with these funds until you have received instructions from the Air Travel Trust.  Travel agents will be individually contacted by the CAA with specific instructions for these bookings.

If you are a Travel Agent or an ATOL holder wishing to provide alternative holidays to consumers of The Holiday Place PLC and wish consumers to assign their claim to you.  In the first instance you should email [email protected] and we will issue you with instructions.
